Consumer Information in E-Commerce for Distant Sale Contracts on the Acquisition of Goods from Karsten Lehmann, Owner of InterTrade: www.plastikhosen.de

If you order goods with us while visiting our homepage or via other distant communication media, please note:

(1)        The conclusion of the contract is exclusively subject to the German or English language.

(2)        For material features of the goods made available by us as well as the validity of limited special offers please refer to the description of the individual goods displayed in our range of goods on the internet.

(3)        The presentation of our goods does not constitute a binding offer on our part. Only after the goods or services have been ordered is the offer binding in accordance with §145 BGB (German civil code). On receipt we will immediately confirm the order (order confirmation). The confirmation is delivered to the e-mail address provided by you on the order form. This order confirmation does not constitute any acceptance of your offer, but is solely a statement acknowledging the receipt of the order. In addition, the customer will once again receive the cancellation policy in written form along with the order confirmation. The contract is only deemed concluded once the supplier has dispatched the goods and confirmed such by sending a second e-mail to the customer (confirmation of dispatch). Goods which have been ordered in the same order procedure, but not listed in the confirmation of dispatch, are not subject to the contract.

(4)        You will be able to recognize any typing errors during the order procedure when confirming at the cash register and correct it at any time by means of the delete or change function before dispatching the order.

(5)        If the goods or services ordered are not available, we reserve the right to refrain from delivering these goods or services.

(6)         The prices specified by us are gross prices and include taxes within the Federal Republic of Germany in addition to packaging and delivery charges.

(7)        The purchase price is immediately due on placement of the order. Payment of the goods is to be made in advance (bank transfer, cheque, Paypal, credit card) or on delivery or in cash on collection.

(8)         Right of withdrawal:
If you are not acquiring the goods for business purposes and freelance business, you are entitled to revoke in accordance with this cancellation policy.

            Execution and Deadline of the Right of Withdrawal:

                You are entitled to withdraw from this contract in writing (e.g. letter, fax, e-mail) within a two-week period without giving reasons or by returning the goods. This term starts from the date when this cancellation policy has been delivered to you at the latest, but not before the goods have been received by you. In the calculation of this term the day you received the cancellation policy in writing or the day the goods were delivered to you is not taken into account.  The limitation period for withdrawal will be complied with if the withdrawal is sent or the goods are returned in due time.

Exceptions to the right of withdrawal:

            The right of withdrawal is invalid or expires when

·                      the data media of audio or video records or software have been unsealed by the customer;

·                      goods which are by nature not suitable for return (e.g. sealed goods after removal of the seal).

            Consequences of withdrawal:

            The performance and payments mutually received and, if applicable, any use made must be returned in the case of an effective withdrawal.  If you cannot fully or partially return the goods or services received from the Supplier or the quality has deteriorated, you must pay appropriate compensation to the Supplier, if applicable.

            This does not apply if the deteriorated quality of the goods can exclusively be connected to the inspection of the goods after delivery has been made, similarly to the way you would have been able to do in a shop. In addition, you can avoid the duty of compensation by not using the goods like an owner and by not impairing the value in any way.

            Goods which can be shipped by parcel are to be returned at the supplier.s expense and risk. This does not apply, that is you must pay the return fees, if the delivered goods meet the requirements of the order and if the price of the goods to be returned does not exceed the amount of 40.00 euros, or in the case of a higher price, if you have not yet made payment or instalment in accordance with this contract at the time of your withdrawal. Otherwise the return of the goods is free of charge for the customer.

            On receipt of the withdrawal we are obliged to refund any payments, if applicable, by making deductions in accordance with the law. You are obliged to return the goods.

(9)        The data required for the fulfilment of the contract between you and us are stored by us.

(10)       We are not subject to any specific code of conduct not mentioned precedently.
